Grading
We'll base your grades on class attendance/participation and an open-book, take-home exam.

The exam will consist of three questions:

  1. Appointing Justices

  2. Selecting Cases

  3. Deciding Cases

We'll ask you to select one question and respond with an answer no longer than 6 pages (including references), double spaced with 1-inch margins, using 12-point Times New Roman font. You will receive the exam on April 25, 2022 (the first day of the exam period). You must complete and return the exam by May 6, 2022 (the last day of the exam period).

If these rules present problems, please contact Prof. Epstein at least one day prior to distribution of the exam. Otherwise, we will not read or give credit to an exam that violates these rules.

Finally, note that ABA Standard 310 requires “not less than one hour of classroom or direct faculty instruction and two hours of out-of-class student work per week or the equivalent amount of work over a different amount of time” for each credit hour awarded. This course is designed to meet this requirement, and each student is expected to spend on average no less than two hours of out-of-class time for each one hour of in-class time, per credit hour.
